There are two types of Investors on the BR Capital platform: Individual Investors and Non-individual Investors, each with its own eligibility criteria.
Individual Investor
An Individual Investor must:
be 18 years old and above;
hold a valid NRIC/MyKad (for Malaysians) or a passport (for non-Malaysians);
have a valid permanent address in Malaysia.
Non-individual Investor
A Non-individual Investor must:
be a company incorporated in Malaysia and/or properly registered with the Registrar of Businesses or the Companies Commission of Malaysia;
be a tax resident in Malaysia, as defined under the Income Tax Act 1967 (“Resident Investor”);
not be a “U.S. Person”;
have a valid email address for electronic communications and account access;
maintain a bank account in its own name with a financial institution in Malaysia that is able to facilitate electronic payments or telegraphic transfers;
pass BR Capital’s internal verification and screening processes, including FATCA and CRS requirements; and
declare its Investor category (e.g. Sophisticated Investor).
Note: All Non-individual Investors are classified as Sophisticated Investors.
Definition of “U.S. Person”
For the purposes of this platform, a “U.S. Person” includes:
- a U.S. citizen or resident individual;
- a partnership or corporation organised in the U.S. or under U.S. laws;
- a trust where:
- a U.S. court has authority over the administration of the trust; and
- one or more U.S. Persons have control over its key decisions; or
- an estate of a deceased person who is a U.S. citizen or resident.
